Terms & Conditions

All participants must make themselves aware of the terms & conditions & accept the risks associated with the activities., Each guest must be responsible for taking out the appropriate personal accident, holiday & cancellation insurance for the full duration of the Retreat. By making full payment of the retreat fee, the Client has accepted and agreed to each of the Terms and Conditions listed below.

To place a booking with Restart Retreat, we require a completed booking form together with the payment of the entire weekend fee. Whether a booking is made by telephone, e-mail or other medium, by completing the booking the client shall be deemed to have read, fully understood & agreed to these Terms and Conditions & signed the declaration on the booking form. All bookings are provisional & are only confirmed when the deposit / payment has cleared our bank account.
Restart Retreat reserves the right to decline any booking at our sole and absolute discretion.

The fee payable at the time of booking shall include the planning, organizing & delivery of the proposed services. Upon the successful payment of the retreat fee by the client a contract is formed for the agreed program to be delivered. If the client wishes to alter any aspect of the program, additional
reasonable costs may be levied by Restart Retreat at our discretion.

The fee does not include travel to & from the site / location at which the proposed services shall be provided & this shall be the sole responsibility of the client.

The client is responsible for their own personal medical requirements for the duration of the services.

It is the client’s responsibility to inform Restart Retreat in writing of any health issues that may make them unsuitable to participate in the services agreed. Failure to disclose any such information may result in Restart Retreat terminating the contract & withdrawing the client from the services without refund, notwithstanding anything to the contrary in condition ”Cancellation by Restart Retreat.”

It is the sole responsibility of the client to ensure that the balance of the cost of their retreat place is paid in full & on time as per the terms set out by Restart Retreat.

It is the client’s responsibility to ensure that they have purchased sufficient & appropriate travel & medical insurance for the full duration of their retreat. Travel and medical insurance are not requirements of the Retreat, but up to the individual client.

Restart Retreat reserves the right to change any price or other particulars of the services before the contract becomes binding. If there is a major change, Restart Retreat shall notify the client forthwith, and shall seek to offer the client arrangements as close to the original as is reasonably possible in the circumstances. If there is any other change other than a major change Restart Retreat is not obliged to inform the client in advance or obliged to
pay any compensation.

If the client wishes to cancel the contract they must advise Restart Retreat in writing as soon as reasonably possible. Any cancellation of the contract will be subject to the following cancellation charges. For the avoidance of doubt, the cancellation charges are based on the number of days before the arrival date of the services.

Restart Retreat will always endeavour to fulfill confirmed bookings, however, we do reserve the right to cancel. If Restart Retreat cancels a booking prior to the commencement of the services, the client will be offered an alternative date, or a refund. The Retreat shall be cancelled if the minimum number of
participants will not be reached, and 100% refund will be provided.

Restart Retreat reserves the right to alter the content of the services at any time without notice to the client due to certain factors, including but not limited to the weather, staff and physical fitness of any of the clients.

Any information on / about our services published by Restart Retreat in its literature & website is designed for illustrative purposes only.

If the client elects not to participate in any of the services being provided, Restart Retreat has no obligation to provide an alternative activity or service & the client will not be entitled to a refund of any part of the retreat

If Restart Retreat believes that a client’s health & safety is at risk,
or a client has failed to disclose any relevant health information in accordance with our Terms & Conditions, Restart Retreat may at it’s absolute discretion make decisions affecting the clients and where necessary may terminate the contract immediately.

The client must refrain from any illegal act or any conduct which may give offense or cause danger or damage to any person or property. If Restart Retreat or any of it’s staff, consultants or agents become aware of any such action then Restart Retreat or any of it’s suppliers may at their absolute discretion have the client immediately removed from any property or facility without refund.

Restart Retreat will have no liability to the client under such circumstances.

EXTRA COSTS incurred by guests while at the retreat
Transportation services organized by the Retreat.
Childcare services organized by the Retreat.
Individual sessions with Valerie Simon during the Retreat.

The definition of full board will be 3 meals per day which will be provided as breakfast, lunch & dinner & on full retreat days only. On arrival day only welcome dinner will be provided & on departure day only breakfast and a light lunch will be provided as part of the Retreat cost.

Restart Retreat venue has accommodations based in a private house, part of “La Capitana” agriturismo.

For retreat durations of 4 nights or less there will be no maid service offered. If a guest requires supplies (fresh towels etc.) or a technician in their suite, the venue staff will only enter when either the guest is in attendance or with the permission of the guest.

If a guest requests additional night/s at the venue, it must be understood that they will be provided strictly on an accommodation only basis, that the cost of any such additional nights will be the sole responsibility of the guest, & that additional nights will not include any of the services provided during the Retreat.

The venue may allow continued access on an accommodation only basis after the Retreat has finished. Each additional night will be charged at the appropriate rate & must be paid directly to “La Capitana”.

The venue has a check out policy which requires guests to vacate their suites on the agreed day of departure by no later than 1 p.m. However, if a guest has a later departure time the venue will endeavour to allow the guest to remain in their suite until their time of departure but it is not guaranteed & is at the discretion of the venue management.

The client understands that attending any activity or service provided by Restart Retreat involves some level of risk. By attending any activity or service provided by Restart Retreat, the client agrees to assume these risks and agrees to release and discharge Restart Retreat and its principals, Directors, employees, agents and representatives from any and all claims for liability.

For example, neither Restart Retreat nor any of its principals, Directors, employees, agents or representatives will be liable for any personal injury, death or loss or damage to any personal property or vehicle belonging to the client during or resulting from the services.

Restart Retreat reserves all copyright which may subsist in the products of, or in connection with, the provision of all activities, services or facilities.

Restart Retreat reserves the right to take such actions as it deems appropriate or necessary to restrain or prevent infringement of such copyright.

Restart Retreat is committed to protecting and respecting your privacy.

Any personal data that you submit will be retained by Restart Retreat for as long as you use the services and systems provided on the web site.

Financial data you submit will not be stored or recorded.

All personal data is stored securely in accordance with the principles of the Data Protection Act 1998.

Any or all of the above data may be required by us from time to time in order to provide you with the best possible service and experience whilst using our web site.

Specific data may be used by us for the following;
Internal record keeping.
To help in improving our products & services.
To transmit via e-mail details of our products & services which may be of interest to you.
Contact for market research purposes, which can include e-mail, telephone, postal mail.

Restart Retreat reserves the right to change this privacy policy as we deem necessary, or as may be required by law. Any changes will be posted on the web site & you are deemed to have accepted the terms of the policy on your first use of the web site following the change/s.

The agreement between the Client and Restart Retreat, the terms of which are set out in these Terms & Conditions, shall be governed by the laws of New York State applicable to contracts entered into and performed entirely within the New York State, and the New York State and US federal courts located in New York County shall have exclusive jurisdiction over any disputes that may arise regarding this agreement.

The following guidelines have been developed to provide safety and consistency in the community, to help you focus on the work you are here to do, and to help preserve our facility for all to enjoy.

Mood altering chemicals, including alcohol, are not allowed. You are prohibited from arriving at the program with the appearance of alcohol/intoxication; if we perceive that you are intoxicated you will forfeit your program fees, you will be asked to leave and you will forfeit your right to participate in the program. All nicotine use in any form is prohibited in this program. Those participants who will be withdrawing from nicotine use will be given special instructions at the opening of the program.

All prescription drugs are to be cleared in advanced by Retreat guide Valerie Simon, LCSW, PAT, who may need to consult with your attending psychiatrist. In the event this becomes necessary, you will be required to sign a medical release form to enable us to work directly with your physician. If you have severe allergies of any kind please come with the necessary approved medication in the unlikely event of any reaction(s).

Also any change in dosage or medication needs to be reported to the supervisor on the first evening of the program. If you bring non-prescription medications to the program that we feel will interfere with your work or your ability to get the most out of this experience, you may be asked to allow us to hold this medication for the duration of the program. If you have any questions prior to or during the program regarding any prescription or non-prescription drugs you need to take, please check with the Retreat’s leaders.

Confidentiality regulations and Restart Retreat’s policies protect your right to anonymity as a participant in this program. We expect that you will protect that right for fellow participants: what you choose to say to others about yourself and/or your experience is up to you. Be aware that because the Restart Retreat is a group process, we cannot guarantee that group participants will keep confidentiality.

Please ask permission of participants before you use your camera. Do not post photos on social networking sites without written permission from all participants in photos. Cameras are not allowed during group process or presentations. Camcorders are prohibited at any time.

We ask that you refrain from discussing your profession during the Retreat.
